Tom Robertson graduated with a B.A. from Austin College in Sherman, Texas, and in 1978 received his J. D. from Emory University School of Law in Atlanta, Georgia. Tom followed his legal education with service as a Trial Attorney with the Equal Employment Opportunity Commission. He returned to Tulsa in 1979 and has since then continuously been in private practice representing employers in Oklahoma and the surrounding states. Tom Robertson has given over 100 presentations to industry groups and legal seminars on labor and employment law topics, and for more than 20 years has served on the Planning Committee of the Multi-State Labor and Employment Law Seminar. He has served as the Chairman of the Labor and Employment Law Section of the Oklahoma Bar Association, and is active in the Tulsa County Bar Association as well, where he has chaired several committees and received the President?s Award for Service in 2003. Tom practices labor and employment law, representing management in all aspects of employment and labor issues. He has defended companies in court on every type of discrimination claim which can be alleged (race, sex, sex harassment, religion, color, national origin, disabled status, age, retaliation and veteran status), as well as Wage and Hour claims. Mr. Robertson has also represented businesses in administrative proceeding before federal and state agencies, such as the EEOC, the U. S. Department of Labor, the National Labor Relations Board, the Oklahoma Department of Labor, and the Oklahoma Human Rights Commission. Tom also has an active practice advising and assisting employers outside of the courtroom with such projects as employee handbooks, drug and alcohol control plans, ADA compliance, FMLA compliance, EEO policies and procedures, Wage & Hour exemption issues and compliance, unemployment compensation appeals, and misconduct investigations. Tom is also experienced in assisting companies in union organizing claims, and in unfair labor practice charges before the NLRB. He has assisted companies in planning and conducting reductions in force, in employee terminations and termination agreements, and sex harassment investigations. Please join us for TEEOCA’s upcoming Mock Trial presentation on Tuesday, February 28th from 5:45 pm – 9:15 pm

The presentation will be a mock (federal) trial of a Title VII claim of sexual harassment/retaliation. The individual plaintiff and the corporate defendant will each be represented by local attorneys with Title VII trial experience and the trial will be presided over by local federal judge, Gregory Frizzell.

Attendees will thus observe a demonstration of the basic elements and order of presentation in a federal jury trial of a Title VII case.

Included for presentation in the time allotted will be:
(1) Opening statements by attorneys for plaintiff and defendant;
(2) Direct and cross examination of the plaintiff and one witness for the plaintiff, including presentation of supporting exhibits;
(3) Direct and cross examination of two representatives of the defendant, including presentation of supporting exhibits;
(4) Closing statements to the jury by attorneys for the plaintiff and defendant; and
(5) Jury deliberation to a verdict.
Included among the topics that will be covered in the course of the trial will be:
(1) What actions may constitute actionable Title VII sexual harassment?
(2) What actions or situations may lead to (and how can an employer thus work to avoid) vicarious employer liability for the acts of its managers and supervisors?
(3) What actions or issues may serve to create a causal nexus between alleged actions of sexual harassment, an employee’s report of same and any subsequent negative employment actions regarding that employee (i.e., the elements of a retaliation claim)?
(4) What are the elements of an effective employer policy prohibiting sexual harassment?
(5) How does (or must) an employee effectively take advantage of such a policy?
(6) How does (or must) an employer effectively utilize such a policy to minimize the risks of liability for sexual harassment liability?

OUR PRESENTERS:

Judge Gregory Frizzell is an Article III Federal Judge for the United States District Court for the Northern District of Oklahoma. He joined the court in 2007 after being nominated by President George W. Bush. Frizzell graduated from the University of Tulsa with his Bachelor’s Degree in 1981 and from the University of Michigan Law School with a Juris Doctor in 1984. Frizzell began his career as a Law clerk for Former Federal Judge Thomas Brett in the United States District Court for the Northern District of Oklahoma. He was a private practice attorney in the State of Oklahoma for several years and then worked as General Counsel for the Oklahoma Tax Commission. In 1997, Frizzell was appointed by the Oklahoma Judicial Nominating Commission to State District Judge for the 14th District of Oklahoma where he served until his appointment to the Federal Bench in 2007.

Mark Solano is a Shareholder at Newton, O’Connor, Turner & Ketchum, where he practices general Labor and Employment Law and is a statewide leader in the area of Immigration Law. Mark earned his Bachelor’s degree in History, magna cum laude, from the University of Albany, State University of New York; where he also earned a Master’s degree in History. Mark went on to receive his Juris Doctor degree, cum laude, from Union University, Albany Law School.In addition to his nearly 30 years of Labor Law experience, and over 20 years of Employment and Immigration law practice before state and federal courts, and administrative agencies, Mark frequently provides lectures and training sessions on Labor and Employment Law related matters and Immigration Law and Procedure to management groups and to professional and employer organizations.Mark is rated AV Preeminent™, the highest rating awarded to attorneys for legal ability and professional ethics by the Martindale-Hubbell Peer Review Rating System.

Lindy H. Collins joined Newton O’Connor Turner & Ketchum, P.C. in 2011. Her practice consists primarily of commercial litigation in state and federal courts. She has been involved in a variety of litigation matters involving bad faith insurance defense, business disputes, employment defense, torts and contract disputes. Ms. Collins received her J.D. from the University of Oklahoma College of Law in May 2011, where she was a Comfort Scholarship recipient. She graduated summa cum laude and with a 4.0 grade point average from the University of Oklahoma in 2008. She is a member of Phi Beta Kappa and Phi Kappa Phi. Ms. Collins is admitted to practice in the U.S. District Courts for the Northern, Western and Eastern Districts of Oklahoma. Ms. Collins is very involved in community outreach, and is currently serving as one of Tulsa’s New Leaders for the Cystic Fibrosis Foundation.

Our speaker, Monica Maple has over 13 years’ experience in representing management in labor and employment matters. She began her own law firm several years ago to better meet the needs of her clients. In addition to labor and employment law, Monica focuses her practice on creditor’s rights, commercial real estate and business transactions, general civil litigation and Indian law.

Monica’s discussion will focus on issues to consider before terminating an employee, such as whether a disciplinary policy exists which governs the situation, whether the employee is a member of a protected class and whether performance and/or disciplinary issues have been documented. She will also discuss the Older Workers’ Benefit Protection Act and its application to terminations.
